Service provider data

Terms and Conditions" (hereinafter ÁSZF) regulate the use of the services of the Balatonlelle Gyöngye Apartment (8638 Balatonlelle Szent István street 2. 2/22.) operated by the Service Provider.

1. Service provider: Private Person indicated above.

2. Guest: The person who actually uses the services of BL Gyöngye Apartman, in the case of a minor guest, the adult or legal representative accompanying the minor.

3. Service: BL Gyöngye Apartman operated by the Service Provider

  • Guests can use it according to the regulations,
  • according to accommodation policy,

4. Reservation: Guests can use the accommodation service of BL Gyöngye Apartman based on a prior appointment.

Contracting parties

1. The services provided by the Service Provider are used by the Guest. If the Guest places the order for the services directly with the Service Provider, the Guest will be the Contracting Party. The Service Provider and the Guest together, if the conditions are met, become contractual parties (hereinafter: Parties or Contracting Parties).

2. If the order for the services is submitted to the Service Provider by a third party (hereinafter referred to as the Intermediary) on behalf of the Guest, the terms of cooperation are governed by the contract concluded between the Service Provider and the Intermediary. In this case, the Service Provider is not obliged to check whether the Intermediary legally represents the Guest.

Scope and creation of the contract 

The Contract between the parties:

a. in the case of online purchases, by sending a confirmation email after finalizing the Booking,

b. in the case of making a reservation by bank transfer (bank, SZÉP card) after booking online, by sending a confirmation email after finalizing the reservation,

Place of performance of the Services: accommodation provided by BL Gyöngye Apartman. 

Reservation

1. Any information, price offer or data provided by the Service Provider to the Guest in writing, orally or by telephone is not considered a Reservation.

2. The Service Provider provides an offer only upon the written request of the Guest. If a specific order is not received within 72 hours from the sending of the offer or by the validity period indicated in the offer, the Service Provider's obligation to offer will cease.

3. The Contract is exclusively yours

a. to the reservation sent by the Guest in writing to the e-mail address balatonlellegyongyeapartman@gmail.com or

b. for an online reservation or purchase initiated on the Service Provider's website www.balatonlellegyongyeapartman.hu upon written confirmation by the Service Provider and with the conditions stated therein, thus the confirmed reservation secured with a service advance is considered a written contract (hereinafter: Contract). Amendments and/or additions to the Agreement require a written agreement approved by the Parties (email). The verbal reservation, agreement, amendment, or its verbal confirmation by the Service Provider does not constitute a contract.

4. The Agreement on the use of accommodation services is valid for a specific period of time.

5. If the Guest permanently leaves the accommodation before the end of the specified period, the Service Provider is entitled to the full consideration for the service stipulated in the Contract. The Service Provider is entitled to resell accommodation that has been vacated before the expiry date.

Responsibility of the parties 

General provisions

1. At the same time as booking the accommodation, the Guest accepts the House Rules and General Terms and Conditions of BL Gyöngye Apartment, and acknowledges that he/she uses the equipment in the apartment at his/her own risk.

2. The guest may use the accommodation solely at his own risk. The guest is responsible for ensuring that the minor child accompanying him/her uses the play equipment in strict compliance with the rules contained in the House Rules, and also informs them of the provisions of the General Terms and Conditions applicable to them, and uses them in accordance with their own age characteristics.

3. The Service Provider is not responsible for the behavior of other Guests.

4. The Service Provider is entitled to refuse (not accept) the Guest's reservation in justified cases, such cases may be:

   a. the Guest untruthfully refuses to provide their data or provides incomplete data

   b. if the Guest's behavior is incompatible with everyday norms, or

   c. the accommodation does not pay the reservation fee in time

   d. does not pay the full consideration for the accommodation reservation in time

5. If it can be assumed that the Guest is not using the facilities of the accommodation according to the contract/or intended purpose, the Service Provider is entitled to prohibit any further use of the BL Gyöngye Apartment with immediate effect and to ban the Guest.

6. The Guest is fully liable for compensation for the regular and proper use of the BL Gyöngye Apartment's equipment. The service provider excludes all liability for damage resulting from unprofessional or illegal use of the BL Gyöngye Apartment. In the event of any damage, the Guest is obliged to compensate the damage caused (material damage and loss due to delay) to the injured party.

7. The Guest is obliged to be fully responsible for any damage caused to the Service Provider or a third party during the use of the BL Gyöngye Apartment in connection with the reprehensible behavior or omission of the Guest and accompanying minor children. This indemnification obligation covers any claim, cost, arising from any claim, deficiency, damage, lawsuit or other official procedure, judgment or decision, procedural costs and attorney's fees.

BL Gyöngye Apartment payment options

1. The reservation to be paid for the services rendered by the Service Provider to the Guest must be settled within 3 calendar days from the receipt of the confirmation e-mail regarding the reservation of the accommodation. If the amount is not received, the Service Provider may cancel the reservation without obligation.

2. The remaining part to be paid for the accommodation must be settled no later than 30 calendar days before arrival. If no written cancellation is made during the fee-free period and the remaining partial amount is not received, the Service Provider may cancel the reservation without obligation, and in this case the amount of the reservation will not be refunded.

3. The Guest must settle the consideration for the service by bank transfer, cash payment or SZÉP card. At our accommodation, we accept OTP Szép Card from 2021 of June. Payment with a Szép card can only be made by bank transfer, the service provider does not have a terminal. For the transfer, please note that in the case of some Szép cards, the transfer may take 5-6 bank working days. In this case, please send us the receipt confirming the transaction received after the successful transaction, and we will finalize your reservation after receiving the amount.

4. In case of payment by bank transfer or Szép card - if the parties do not stipulate otherwise in the individual agreement concluded with the Service Provider - the Guest must transfer the consideration for the ordered services to the Service Provider's bank account by the 30th day before the specified date of arrival in such a way that the Service Provider is credited to his bank account or the Guest confirms the transfer with an irrevocable statement issued by the account manager's financial institution confirming that the transfer has taken place.

5. If the reservation falls within 30 calendar days from the date of arrival, we will finalize it within 3 days (72 hours) after receiving the confirmation e-mail after remittance of the cost of the entire accommodation reservation, of which 30% is considered a reservation. If the full cost of the accommodation is not received within 3 calendar days after sending the confirmation e-mail, the service provider has the right to withdraw.

6. Tourist tax (IFA) cannot be paid with the Szép card.

7. In case of earlier departure after arrival, we are unable to refund the canceled days.

Accommodation prices

1. In case of accommodation, the price to be paid is per night/apartment, for a maximum of 1-4 people.

2. It is not possible to place an extra bed.

General rules

1. The BL Gyöngye Apartment and its parking area can only be entered after a valid reservation and payment of the full price.

2. Based on the confirmation (Contract) sent at the time of booking, it is necessary to pay a minimum of 30% of the total price by bank transfer or credit card within 72 hours (3 days) of the booking

3. The guest may use the accommodation solely at his own risk. The guest is responsible for ensuring that the minor child accompanying him/her uses the play equipment in strict compliance with the rules contained in the House Rules, and also informs them of the provisions of the General Terms and Conditions (ÁSZF) applicable to them, and uses them in accordance with their own age characteristics.

Cancellation and amendment conditions

1. In case of cancellation before the 24th hour of the 15th calendar day before the day of arrival, the amount of the reservation will be refunded. In case of cancellation after that, the amount of the reservation will not be refunded, the service provider is entitled to keep it as compensation. In the event of cancellation, the Service Provider is entitled to keep the advance payment requested and paid for the provision of the service as compensation.

2. In the event of a request to change a reservation that has already been booked, the Service Provider reserves the right to keep the reservation received for the original reservation as compensation, or to refund it, depending on whether it suffers damage or disadvantages as a result of the reservation modification.

3. The Service Provider reserves the right to unilaterally modify the provisions contained in the General Terms and Conditions regarding the operation, use and fees of the BL Gyöngye Apartment for the future at any time. Such a modification does not apply to already booked appointments. The service provider publishes the changes in the GTC and the price of the services on its website.

4. he Service Provider is entitled to terminate the Agreement with immediate effect, thus refusing to provide services, if:

    a. the Guest does not use the provided accommodation, equipment,

    b. the Guest does not, or only partially, complies with the rules laid down in the House Rules,

    c. the Guest is under the influence of alcohol or drugs,

    d. the Guest exhibits threatening, insulting or other unacceptable behavior towards anyone;

    e. the Guest suffers from an infectious disease;

    f. the Contracting Party does not fulfill its service reservation payment obligation specified in the Contract by the specified date,

5. If the Agreement between the Parties is not fulfilled due to force majeure, the Agreement shall be terminated.

6. If the fulfillment of all or a significant part of the services is not possible for some reason, the public will be notified on the website of BL Gyöngye Apartman, and the registered Guests, if possible, by e-mail, informing them about the possibilities of using the services that have already been partially or fully paid for.

7. Cancellation conditions for payment made with a Szép card: 

In case of cancellation, the advance transferred from the SZÉP card - in accordance with the government decree on the rules for the use of SZÉP cards cannot be transferred to cash, bill money, or other means of payment that replace cash - we can only return it to the SZÉP card. The refund process is extremely lengthy, so with this in mind, it is worth considering whether the payment should be made with a SZÉP card.

8. In accordance with the cancellation conditions, we charge a 10% handling fee in all cases!

The procedure used during the temporary measure has been cancelled! 

Procedure applied during transitional measures: 

Based on the effective Government Decrees 484/2020 (XI.10), 215/2021 (IV.30) on accommodation, we can only receive guests during the restrictions in the following cases: in case of arrival for economic (work) or educational purposes, with a certificate issued by your employer or educational institution (https://koronavirus.gov.hu/sites/default/files/sites/default/files/imce/munkaltatoi_igazolas-.pdf) a person protected against the corona virus who has a valid protection card, as well as a person under the age of 18 coming under their supervision business (verified by a declaration of business purpose) The certificate is intended to prove the legality of the use of the accommodation. The document can also be sent by e-mail after the reservation, and the original issued document can be kept by the accommodation, at least for the duration of the guest's stay at the accommodation, so the legality of this must be checked!


Other:

We can keep valuables left in the room for 2 months, if we are notified, we will mail them to the address provided within the specified time.

In order to ensure the tranquility of the Guests and neighbors, it is forbidden to make noise, play music or listen to music in the Apartment between 10:00 p.m. and 8:00 a.m.

Please note that the accommodation provider is not in a position to take responsibility and pay compensation for damages resulting from events that are not his fault (e.g. natural disasters, hail, fire, power outages, injuries caused in the parking lot, etc.).

The service provider is not responsible for damage caused to the car parked in the parking lot.

The accommodation provider reserves the right not to accept guests who behave scandalously and who do not follow the house rules, or to immediately remove them from the accommodation.

We reserve the right to change the price.
